Please read these Terms carefully and ensure you understand them before using the Services. By using the Services, you agree to be bound by these Terms.

When we refer to "OTX," "we," "us," or "our," we mean OMEGATRADERS SYSTEMS LIMITED. When we refer to "you" or "your," we mean you, the person or company using the Services.

3. Our Services
We provide the OTX white-label mobile application, which integrates with the MT5 platform, along with support services and complementary offerings.
4. Our Liability
- If we fail to comply with these Terms in providing the Services, we will make reasonable efforts to resolve the issue as promptly as possible. However, we are not responsible for any loss or damage that is not foreseeable.
- We are not liable for any indirect, special, or consequential losses, including loss of profit or data, arising from your use of our Services, except in cases of fraud, willful misconduct, or gross negligence.
- In jurisdictions where limitations of liability are not permitted, our liability shall be limited to the maximum extent allowed by law.
5. Delivery
- We will send email notifications regarding your payment status, set up form for app connection, app delivery and renewal reminders. Please check your mailbox regularly, including your junk folder, to ensure you do not miss any important updates.
- The APK file will be ready within 5 business days after we receive the initial payment as well as necessary information on the app set up form.
- Along with the APK file, we will provide the necessary information for MT5 integration setup via email, allowing you to manage the process independently and activate the app seamlessly.
- The billing date of the monthly service fee will begin 3 days after the APK delivery, and you will be notified in the same email.
- Please comply with the guidelines outlined on the OTX portal for listing your white-label app on the iOS and/or Android marketplace. To assist with the upload process, please grant us access to your iOS or Android developer account. Additionally, you are responsible for completing any other relevant information required for the listing.
6. Payment Terms and Renewal
- Payments can be made online or via wire transfer in the currency specified on the payment portal. A service renewal reminder email will be sent to you 7 days before the expiry date.
- Please adhere to your chosen plan and services during the contract period. If you wish to upgrade your plan, you may do so at the next renewal.
7. Refunds and Cancellation
- If you find the service unsuitable for your needs, you may request a refund via email to sales@omegatraders.com, providing your sales order number.
- Please note that Refunds for the paid service fee are only allowed within the first 7 days after the APK file is deployed, and only before it is listed on the App Store or Play Store.
- Refunds will be issued through the original payment method following confirmation from OTX team via email notification.
- The refund will cover the full amount of the service fee (monthly, quarterly, or yearly). However, setup fee is not eligible for refunds under any circumstances.
- The timeline for processing refunds may vary depending on the payment method used.
- The processing time for refunds varies by payment method:
- PayPal: Approximately 7 business days
- Credit Card: Approximately 7 business days
- Wire Transfer: Timing depends on your bank.
8. Intellectual Property
We own or license all intellectual property rights in the trading app, website, and their content. You may not extract or reuse any part of the app, website, or content without our prior written consent. Unauthorized use of our intellectual property may result in legal action.
9. Customer Support
The Support Service outlined below will be provided throughout the entire contract term:
- Technical Support: Available during business office hours via Telegram for platform-related issues.
- General Support: E-mail and chatbot support for general inquiries and assistance.
10. Disclaimer
- The technology platform provided is for support purposes only. Brokers and their traders bear their own risk in trading activities. We do not guarantee profitability or success in trading.
- We make no representations or warranties regarding the accuracy, reliability, or completeness of the content on our website or Services.

11. Data Protection and Privacy
We comply with applicable data protection regulations under the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. By using our Services, you consent to the collection and processing of your personal data as outlined in our Privacy Policy.
12. Events Outside Our Control
We are not liable for any failure to perform due to events outside our control, such as natural disasters, wars, or government actions. In the event of such occurrences, our obligations will be suspended until the event concludes.
13. Dispute Resolution
- Any disputes arising out of or relating to these Terms shall be resolved through negotiation in good faith. If unresolved, they shall be submitted to binding arbitration in accordance with the rules of the Hong Kong International Arbitration Centre.
- The governing law shall be that of the Hong Kong Special Administrative Region, and any arbitration shall take place in Hong Kong.
